General Conditions of Membership Registration and Internal Regulations

1. Association Registration

   By completing this membership registration form, the undersigned requests membership in ARKE' Amateur Sports Association and declares to:

   - Want to participate in the association's life, accepting without reservation the Association's Statute and internal regulations regarding the use of equipment and assets of the Association.

   - Respect the statutes and rules established by AlCS and ASI.

   - Accept and adhere to the norms and directives of CONI.

 

   Additionally, the undersigned requests enrollment in the training courses provided by ARKE' Amateur Sports Association. The courses will be provided according to the contents, methods, and participation contributions explicitly specified in the informative material available at the Association's secretariat and website.

 

2. Registration Procedure

   Membership registration is considered completed upon acceptance by the Board of Directors of the membership request and is subject to admission to the course by the Association and payment of the membership fee and the entire participation contribution, based on the selected course.

 

   It is necessary for course participants to demonstrate physical fitness through a medical certificate to be presented on the first day of the course, explicitly stating that there are no contraindications to physical exercise (D.M. 28.02.1983 art. I).

 

3. Payment Procedure

   Payment of the membership fee and the fee for the courses for each period must be made simultaneously with registration or renewals.

   Participation fees are differentiated according to the frequency of the selected course.

 

   In case of non-payment, participation in the course will not be allowed. Participation fees include closure periods and holidays according to the calendar available at the secretariat. These periods will not be deducted or refunded from the contributions as the paid contribution already takes into account such interruptions.

 

4. PRIVACY POLICY

Users are informed that Legislative Decree no. 196/2003 provides for the protection of individuals and other subjects regarding the processing of personal data.

 

In accordance with the aforementioned laws, such processing will be based on the principles of fairness, lawfulness, and transparency, safeguarding the confidentiality and rights of the subscriber. The following information is provided pursuant to Article 13 of Legislative Decree no. 196/2003. The processing we intend to carry out:

 

a) is aimed at concluding, managing, and executing the requested services; organizing, managing, and executing the provision of services also by communicating data to our third-party suppliers; communicating advertising messages relating to the institutional activities of the Association; fulfilling legal obligations or other requirements requested by competent Authorities;

b) will be carried out using both electronic and paper methods;

c) except as strictly necessary for the correct execution of the supply contract, data will not be communicated to other parties without your express consent.

 

The Data Controller is ARKE' — Amateur Sports Association, C.so Casale 137, 10132 Turin, to which you may address to assert your rights as provided for in Article 7 of Legislative Decree no. 196/2003, which is reproduced below in full:

 

Art. 7 Right to access personal data and other rights

1. The data subject has the right to obtain confirmation as to whether or not personal data concerning him exist, even if not yet recorded, and their communication in intelligible form.

2. The data subject has the right to obtain indication:

a) of the origin of personal data;

b) of the purposes and methods of processing;

c) of the logic applied in case of processing carried out with the aid of electronic instruments;

d) of the identifying details of the controller, of the processors and of the designated representative pursuant to Article 5, paragraph 2;

e) of the subjects or categories of subjects to whom the personal data may be communicated or who may become aware of it as designated representative in the territory of the State, processors or persons in charge.

3. The data subject has the right to obtain:

a) updating, rectification or, when interested, integration of data;

b) erasure, anonymization or blocking of data that have been processed unlawfully, including data whose retention is unnecessary for the purposes for which they have been collected or subsequently processed;

c) certification that the operations referred to in letters a) and b) have been notified, also as regards their contents, to those to whom the data were communicated or disseminated, except where such compliance is impossible or involves a manifestly disproportionate use of resources compared to the protected right.

4. The data subject has the right to object, in whole or in part:

a) on legitimate grounds, to the processing of personal data concerning him/her, even though they are relevant to the purpose of the collection;

b) to the processing of personal data concerning him/her for the purpose of sending advertising materials or direct selling or for carrying out market research or commercial communication.

 

5. PROGRAM CHANGES

The Association reserves the right to modify the dates, times, teachers, and contents of the Courses and association activities.

 

6. RESPONSIBILITY

ARKE' — Amateur Sports Association shall not be held responsible in the following cases:

a) for any damages that members may suffer during classes and/or within the premises for reasons not attributable to it;

b) for any direct or indirect damages that may occur to members, other than force majeure or fortuitous event, due to the acts of other members or third parties in general;

c) for the non-performance and/or interruption of classes or courses attributable to causes beyond its control;

d) for the objects and materials brought into the premises by the associate;

e) for any damages caused by objects and/or materials brought by the associate into the premises of the Association, for which the associate assumes full and exclusive responsibility.

f) for objects and valuables forgotten in the dressing rooms. Forgotten objects found by the staff of the Association will be kept and can be collected within 15 days at the Organizational Secretary's Office. After this period, the Association assumes no responsibility for the fate of the found objects delivered to the Organizational Secretary's Office.

 

7. CLOTHING

Associates must wear neat clothing appropriate to the activity being carried out, allowing the instructor to observe and correct.

It is forbidden to wear dangling earrings, watches, necklaces, and bracelets to ensure safety during the lesson.

The associate is aware that for some courses, specific clothing may be required, which will be indicated at the first lesson or at the time of enrollment.

Inside the rooms, only footwear suitable for use, perfectly clean, and not coming from outside are allowed.

In order to ensure the best hygiene, the associate undertakes to respect these rules. Otherwise, the management reserves the unappealable right to exclude the associate from the lesson without this entailing any right to refund amounts in favor of the associate or the waiver of the obligation to pay by the same.

 

8. BEHAVIORAL RULES

Smoking is strictly prohibited inside the Association's premises, including electronic cigarettes.

It is essential to arrive punctually for classes and not to leave before the end.

The associated student enrolls in the chosen type of activity and may not make claims or complaints if the instructor is replaced or changed for personal or didactic reasons, which will be evaluated with seriousness and competence by the management.

Decisions taken by the board of directors and didactic council in this regard are final. Attending classes is possible only with the consent of the instructor and for the entire duration of the lesson.

Movements from one course to another must be authorized by the instructor.

Minors associates are under the responsibility of the instructors only during class hours. Parents of young associate students are kindly requested to avoid attending classes to avoid distractions.

If they stay inside the facility, they are not covered by A.I.C.S. insurance; the Arkè association is responsible only for registered associates. Events and shows are not mandatory, but if you do not intend to participate, you are invited to notify the secretariat and the instructor well in advance; even those who do not participate in the performance are invited to learn the choreography, which is an integral part of the educational program. Associates are invited to participate in the democratic life of the Association by attending assemblies.

9. DISCIPLINARY SANCTIONS

Failure to comply with one or more points of this regulation or, in any case, the failure to respect the basic rules of civil coexistence, may result in the right of the Association to decree the immediate expulsion of the defaulting associate without accruing in his/her favor the right to the refund of any amounts already paid.

 

10. COMPETENT COURT

Any dispute arising from this regulation will be submitted to conciliation in accordance with the provisions of the Regulation of the Arbitration Chamber of Piedmont, which is fully invoked herein. In the event of unsuccessful conciliation, the dispute will be referred to the court of Turin.
